Terms of Service

Please read these Terms of Service ("Terms") carefully before using ReviewPing. By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use ReviewPing.

1. Description of Service

ReviewPing is a subscription-based software service that allows home service contractors and small businesses ("you" or "User") to send automated SMS review request messages to their customers. After you log a job in the ReviewPing dashboard, we send a text message to your customer's phone number 24 hours later, requesting a Google review.

The service includes a cancellation window: you may cancel any pending message before it is sent.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business. ReviewPing is intended for use by businesses, not consumers.

3. User Responsibilities and SMS Compliance

Important: You are solely responsible for ensuring that all customer phone numbers you submit to ReviewPing belong to individuals with whom you have an established business relationship. ReviewPing transmits messages on your behalf — you are the originating party.

By using ReviewPing, you agree to the following:

You will only submit phone numbers for customers who have provided their number to you voluntarily in the context of a legitimate business transaction (e.g., they hired you to perform work at their home or property).
You will not submit phone numbers for individuals with whom you have no prior business relationship.
You will not use ReviewPing to send unsolicited commercial messages, spam, or messages that violate the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, or any other applicable federal, state, or local law.
You will not use ReviewPing for any fraudulent, deceptive, or illegal purpose.
You will honor all opt-out requests. Customers who reply STOP to a ReviewPing message will be placed on a suppression list and will not receive future messages from your account.
You will ensure your use of ReviewPing complies with applicable carrier guidelines and any requirements from the Campaign Registry (10DLC) or similar programs.

We reserve the right to suspend or terminate your account immediately if we believe you are violating these Terms or applicable law.

4. Message Content

ReviewPing sends review request messages in a standardized format that includes: your business name, a link to your Google review page, and opt-out instructions. We do not allow custom free-form messages that bypass these components. You are responsible for providing an accurate business name and Google review link.

5. Account Registration and Security

You agree to provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at alluragensin@protonmail.com if you suspect unauthorized access to your account.

6. Payment Terms

ReviewPing is offered at $10.00 per month, billed on a recurring monthly basis.

Your subscription begins after any applicable free trial period ends.
Billing is automatic — your payment method will be charged on the same day each month.
All payments are in U.S. dollars.
Fees are non-refundable except where required by law or at our sole discretion.
If a payment fails, we will attempt to retry the charge. If payment is not received after retry attempts, your account may be suspended until payment is resolved.

We reserve the right to change our pricing with 30 days' advance notice to the email address on your account.

7. Free Trial

We may offer a free trial period (currently 30 days) to new users. During the free trial, you have full access to the service. No charge is made during the trial period. At the end of the trial, your subscription automatically begins and you will be billed $10/month unless you cancel before the trial ends.

8. Cancellation

You may cancel your ReviewPing subscription at any time by contacting us at alluragensin@protonmail.com or through account settings (when available).

Cancellation takes effect at the end of the current billing period.
You will retain access to the service through the end of the paid period.
We do not prorate partial months.
After cancellation, your data will be retained for 30 days and then deleted per our Privacy Policy.

9. Acceptable Use

You agree not to:

Use ReviewPing to harass, threaten, or harm any individual
Attempt to reverse engineer, copy, or resell the service
Use automated means to access the service (bots, scrapers) beyond normal use
Interfere with or disrupt the integrity or performance of the service
Upload or transmit any malicious code or harmful content

10. Intellectual Property

ReviewPing and its original content, features, and functionality are owned by Allura Gensin and are protected by applicable intellectual property laws. You retain ownership of your business data (customer names, phone numbers, job records) that you input into the service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT MESSAGES WILL BE DELIVERED SUCCESSFULLY IN ALL CASES (SMS DELIVERY IS SUBJECT TO CARRIER POLICIES AND TECHNICAL FACTORS OUTSIDE OUR CONTROL).

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, REVIEWPING AND ALLURA GENSIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF GOODWILL, OR DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE SERVICE AND COMPLIANCE WITH ALL APPLICABLE LAWS, INCLUDING LAWS GOVERNING SMS MARKETING AND CONSUMER COMMUNICATIONS. WE SHALL NOT BE LIABLE FOR ANY CLAIMS, FINES, OR DAMAGES ARISING FROM YOUR VIOLATION OF APPLICABLE LAW OR THESE TERMS.

13. Indemnification

You agree to indemnify, defend, and hold harmless ReviewPing and Allura Gensin from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any applicable law, including laws governing SMS communications; or (d) any claim by a third party arising from messages sent through your ReviewPing account.

14. Termination

We reserve the right to suspend or terminate your access to ReviewPing at any time, with or without notice, for any violation of these Terms or applicable law, or if we believe your use poses legal or reputational risk to the service. Upon termination, your right to use the service immediately ceases.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict of law principles. Any disputes arising from these Terms or your use of ReviewPing shall be resolved in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of such courts.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the service. Continued use of ReviewPing after changes take effect constitutes your acceptance of the revised Terms.
